This EULA is a legal agreement between you ("You") and Sergey Sherbak ("StreamSoft") and governs your use of the PingTools Mobile Application ("Software").
Please carefully read the following terms and conditions before using the Software. Installation or use of the Software indicates your acceptance of this EULA and Software Privacy Policy. If you do not agree with the following, do not use the Software and remove it from your mobile device and storage systems.
License
Subject to the terms of this EULA, StreamSoft grants You a limited, non-exclusive, non-transferable
and revocable license to use the Software on any mobile device owned or controlled by You.
Maintenance, Support & Update.
You acknowledge that while StreamSoft may provide maintenance and support and updates for the Software from time to time.
But StreamSoft will have no obligation whatsoever to furnish such services to You and may terminate such services at any time without notice.
No Warranty
You agree that your use of the Software is at your sole risk, and the Software is provided on an "As
is" and "As available" basis. StreamSoft expressly disclaim all warranties of any kind, whether express or
implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of Liability
Because some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential
damages, some of the exclusions or limitations set forth below may not apply to you. You specifically agree that
StreamSoft will not be liable to you for any indirect, incidental, special, consequential or exemplary damages,
including damages for loss of profits, use, data, cost of procurement of substitute goods or services,
or other intangible losses, resulting from the use or inability to use the Software or in any way relating to the Software.
Third Party Agreements
You must comply with any applicable third party terms of agreement when using the Software.
In particular, You acknowledge that use of the Software may result in increased charges from your wireless carrier
and that You are solely responsible for paying such charges.
Distribution
StreamSoft the owner of the copyright of this Software, all of its derivatives, title and accompanying
materials are the exclusive property of StreamSoft. All rights of any kind, which are not expressly granted in this
EULA, are entirely and exclusively reserved to and by StreamSoft. You are allowed to distribute the free version of
this Software. But You may not rent, lease, transfer, modify, translate, reverse engineer, de-compile,
disassemble or create derivative works based on this Software. You are not allowed to distribute the paid version of
this Software. To do this, you must request a commercial license from StreamSoft.
General
This EULA and the relationship between You and StreamSoft will be governed by the laws of the Russian
Federation. You agree to submit to the personal and exclusive jurisdiction of the courts located in Belgorod,
Belgorod federal subject of Russian Federation to resolve any dispute or claim arising from this EULA. As to
intellectual property rights, You specifically agree that StreamSoft may file an action in any jurisdiction to
protect or enforce its rights. You may not assign or transfer any of your rights or obligations under this EULA to a
third party without the prior written consent of StreamSoft. StreamSoft may freely assign this EULA.
